1. Scope and contracting party

1.1 These terms apply to all orders placed through the book shop on herbertwillisociety.org.

1.3 The shop sells to consumers only within the meaning of section 1(1)(2) of the Austrian Consumer Protection Act. Purchases by businesses are excluded via this route. Companies wishing to obtain the book are asked to write to us; we handle such orders individually.

1.4 Deviating terms of the buyer do not become part of the contract unless we expressly agree to them in writing.

2. Formation of contract

2.1 The presentation of the book on the website is not a binding offer but an invitation to order.

2.2 By submitting the order form using the button “Buy now” you make a binding offer to purchase. You are then forwarded to our payment service provider.

2.3 The contract is formed once we accept your order by sending the order confirmation by e-mail. We send that e-mail after payment has been received; it contains the invoice and the withdrawal instructions.

2.4 You may order up to four copies at a time; they travel to you in one shipment. If you would like more, please write to us — we handle such orders individually.

2.5 We store the text of the contract. You receive it with the order confirmation; we do not make it available for retrieval beyond that. Please keep the order confirmation.

3. Prices and shipping costs

3.1 The price of the book is EUR 29.00 per copy, including 10 % Austrian VAT.

3.2 Shipping costs are charged in addition. They apply per shipment, not per copy, and are shown before you submit the order:

3.3 No Austrian VAT is shown for deliveries to Switzerland and Liechtenstein; these are tax-exempt export deliveries pursuant to section 6(1)(1) of the Austrian VAT Act. See section 9.

3.4 The book is subject to the Austrian Fixed Book Price Act. The EUR 29.00 is the retail price set by the publisher Schott Music GmbH & Co. KG, Mainz. We may not undercut it; the Act permits a discount of no more than 5 %. Promotional discounts, vouchers and quantity discounts are therefore not possible: four copies cost exactly four times EUR 29.00. The shipping rates staged by quantity in section 3.2 are not a discount on the book but the postage for the shipment in question.

4. Payment

4.1 Payment is processed by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.

4.2 The available payment methods are shown during checkout. No surcharge is levied for using a particular payment method.

4.3 The purchase price falls due immediately upon formation of the contract. We ship only after payment has been received.

5. Delivery and delivery area

5.1 We deliver to the member states of the European Union as well as to Switzerland and Liechtenstein. Other destinations cannot be selected in the order form; please write to us in that case.

5.2 We ship to the delivery address you provide. Please check it before submitting — a later change is only possible while the parcel has not yet been handed over to the carrier.

5.3 We hand your parcel over to the postal service within three working days of receipt of payment. How long carriage takes after that depends on the carrier's transit times and is outside our control.

5.4 We ship as an insured parcel. The book remains our property until it has been paid for in full.

6. Right of withdrawal

6.1 Consumers have a statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act. The details and the period follow from the withdrawal instructions, which you can read together with the model withdrawal form before ordering and which you receive again with the order confirmation.

6.2 None of the exceptions in section 18 of that Act applies to the sale of a printed book. The right of withdrawal therefore exists without restriction.

7. Warranty

7.1 The statutory warranty provisions of the Austrian Civil Code and the Consumer Warranty Act apply. The warranty period for movable goods is two years from handover.

7.2 If the book is defective — missing or wrongly bound pages, for instance — please write to us. We will replace or repair it; if neither is possible or is disproportionate for us, you may demand a price reduction or rescission of the contract.

7.3 Your warranty rights exist independently of the right of withdrawal under section 6.

8. Liability

8.1 We are liable without limitation for intent and gross negligence, under the Austrian Product Liability Act, and for injury to life, body or health.

8.2 For slight negligence we are liable only for breach of an essential contractual obligation, and limited in amount to the foreseeable damage typical of this type of contract.

8.3 Any further liability is excluded. The provisions of the Austrian Consumer Protection Act remain unaffected.

9. Customs and import duties for deliveries to Switzerland and Liechtenstein

9.1 Shipments to Switzerland and Liechtenstein leave the customs territory of the European Union. They may incur import duties, customs charges and clearance fees, which are payable by the recipient. These amounts are not included in the purchase price or in the shipping costs.

9.2 Their level is determined by the law of the destination country. We have no influence over it and cannot state the amount in advance.

9.3 An invoice for customs clearance is enclosed with the shipment.

9.4 Refusing acceptance because of import duties does not count as a withdrawal. In that case you bear the cost of the return.

10. Language of the contract

The contract may be concluded in German or in English. The language in which you completed the ordering process governs.

11. Dispute resolution

11.1 The European Commission shut down its online dispute resolution platform on 20 July 2025. A reference to that platform is therefore omitted.

11.2 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

12. Governing law and jurisdiction

12.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

12.2 If your habitual residence is in another state, the mandatory consumer protection provisions of that state remain unaffected by this choice of law.

12.3 For actions against consumers, the court of their place of residence has exclusive jurisdiction. No deviating place of jurisdiction is agreed.

13. Final provisions

13.1 Should any provision of these terms be invalid, the remainder of the contract remains effective.

13.2 The version of these terms published on the website at the time of your order applies.
